Meselelerin us\u00fbl\u00ee boyutuna dair herhangi bir malumat sahibi olmayan ki\u015filere ilk bak\u0131\u015fta mant\u0131kl\u0131 gibi gelen bu gerek\u00e7eler esasen tam anlam\u0131yla bir \u201chalt etme\u201d i\u015flevinden ibarettir. \u00d6zt\u00fcrk, bu gibi konularda kendi g\u00f6r\u00fc\u015f\u00fcn\u00fc teyit amac\u0131yla uleman\u0131n da g\u00f6r\u00fc\u015flerini zikretmekte ve okuyucuya ismi ge\u00e7en alimlerin de kendi g\u00f6r\u00fc\u015f\u00fcnde olduklar\u0131 intiba\u0131n\u0131 vermektedir. Oysa bu hem samimiyetsizlik hem de ulemaya kar\u015f\u0131 kas\u0131tl\u0131 bir iftira c\u00fcrm\u00fcd\u00fcr. Ne demek istedi\u011fimizi daha da anla\u015f\u0131labilir k\u0131lma ad\u0131na \u00d6zt\u00fcrk\u2019\u00fcn ahk\u00e2m ayetlerinin tarihsel olduklar\u0131n\u0131 ispat sadedinde zikretti\u011fi birka\u00e7 misal ve bu misal \u00fczerinde s\u00f6ylediklerine bir g\u00f6z atal\u0131m:<\/p>\n<p><strong>\u00dc\u00c7 KERE \u0130Z\u0130N \u0130STEME MESELES\u0130<\/strong><\/p>\n<p>\u00d6zt\u00fcrk\u2019\u00fcn ilgili ayetle ilgili iddias\u0131 aynen \u015f\u00f6yledir:<\/p>\n<p><strong><em>\u201c<\/em><em>Mesela, &#8220;Ey m\u00fcminler! K\u00f6leler ve cariyeleriniz ile hen\u00fcz ergenlik \u00e7a\u011f\u0131na eri\u015fmemi\u015f \u00e7ocuklar\u0131n\u0131z odan\u0131za girmek i\u00e7in \u015fu \u00fc\u00e7 vakitte sizden izin istesinler: Sabah namaz\u0131ndan \u00f6nce, \u00f6\u011fle s\u0131ca\u011f\u0131ndan solay\u0131 soyunup dinlenmeye \u00e7ekildi\u011fini zaman ve bir de yats\u0131 namaz\u0131ndan sonra. \u0130\u015fte bu \u00fc\u00e7 vakit, \u00f6rt\u00fclmesi gereken yerlerinizin a\u00e7\u0131k halde bulunabilece\u011fi vakitlerdir. Di\u011fer vakitlerde birbirinizin yan\u0131na girip \u00e7\u0131kman\u0131zda sizin i\u00e7in de onlar i\u00e7in de bir sak\u0131nca yoktur. \u0130\u015fte Allah mesajlar\u0131(n\u0131) size b\u00f6yle a\u00e7\u0131kl\u0131yor. \u00c7\u00fcnk\u00fc Allah (sizin i\u00e7in neyin iyi neyin k\u00f6t\u00fc oldu\u011funu) \u00e7ok iyi bilendir; her neylerse g\u00fczel eyleyendir.&#8221; mealindeki 24\/Nur 58. ayetin tefsiriyle ilgili rivayette belirtildi\u011fine g\u00f6re Irakl\u0131 bir grup M\u00fcsl\u00fcman \u0130bn Abbas&#8217;a gelerek, &#8220;Ey \u0130bn Abbas! \u00dc\u00e7 vakitte evlere izin isteyerek girmemizi emreden bu ayetteki h\u00fck\u00fcmle ilgili g\u00f6r\u00fc\u015f\u00fcn nedir? Zira (g\u00fcn\u00fcm\u00fczde) bu ayetteki h\u00fck\u00fcmle hi\u00e7 kimse amel etmiyor?&#8221; diye sorar. \u0130bn Abbas ise \u015fu mealde bir cevap verir: Vakti zaman\u0131nda insanlar\u0131n (m\u00fcminlerin) evlerinde d\u0131\u015far\u0131dan gelenlerin i\u00e7eri girmelerini engelleyecek kap\u0131, b\u00f6lme gibi \u015feyler yoktu. Dolay\u0131s\u0131yla bir kimse kar\u0131s\u0131yla birlikte yat\u0131yorken k\u00f6lesinin veya \u00e7ocu\u011funun ans\u0131z\u0131n i\u00e7eri girdi\u011fi oluyordu. Bu y\u00fczden Allah bu \u00fc\u00e7 avret vakitte onlara izin isteyerek evlere girmeyi emretti. Daha sonra Allah onlara kap\u0131l\u0131, b\u00f6lmeli ev sahibi olma imk\u00e2n\u0131 l\u00fctfetti. (G\u00fcn\u00fcm\u00fczde) bu h\u00fck\u00fcmle amel eden birine ben de rastlamad\u0131m. G\u00f6r\u00fcld\u00fc\u011f\u00fc gibi, \u0130bn Abbas baz\u0131 h\u00fck\u00fcmlerin de\u011fi\u015fen \u015fartlar muvacehesinde i\u015flevsiz kalabilece\u011fini rahatl\u0131kla s\u00f6yleyebilmi\u015ftir. Nitekim \u0130bn\u00fc&#8217;l-Arab\u00ee de \u0130bn Abbas&#8217;\u0131n &#8220;Bu ayetteki h\u00fck\u00fcm i\u015flevsizdir&#8221; dedi\u011fini nakletmi\u015ftir. H\u00e2l b\u00f6yle iken g\u00fcn\u00fcm\u00fczde, Kur&#8217;an&#8217;daki her h\u00fckm\u00fcn olgusal ba\u011flam\u0131 d\u0131\u015f\u0131nda mutlaka bir anlam ta\u015f\u0131mas\u0131 gerekti\u011fine ili\u015fkin yayg\u0131n ve yerle\u015fik bir fikri sabit olu\u015fmu\u015f ve t\u00fcm yorumlar bu fikir ekseninde olu\u015fturulmu\u015ftur.\u201d<a href=\"#_ftn1\" name=\"_ftnref1\">[1]<\/a><\/em><\/strong><\/p>\n<p>G\u00f6r\u00fcld\u00fc\u011f\u00fc gibi \u00d6zt\u00fcrk bu ifadeleriyle Nur s\u00fcresinin 58. Ayet-i kerimesinde yer alan h\u00fckm\u00fcn tarihsel oldu\u011funu iddia etmekte ve bu g\u00f6r\u00fc\u015f\u00fcne de \u0130bn Abbas (rad\u0131yallahu anh)\u2019\u0131n s\u00f6z\u00fcyle delil getirmektedir. Oysa \u00d6zt\u00fcrk\u2019\u00fcn bu \u015f\u00fcphesi de tamamen konuyu anlayamam\u0131\u015f olmaktan ne\u015fet etmektedir. Zira bu mevzu tamamen us\u00fbl\u00ee \u00e7er\u00e7evede ele al\u0131nmas\u0131 gereken bir mevzudur. \u015e\u00f6yle ki, Kav\u00e2id-i f\u0131khiyye kitaplar\u0131m\u0131zda \u015f\u00f6yle bir kaide mevcuttur: \u00a0\u201c\u00a0 \u0627\u0644\u062d\u0643\u0645 \u064a\u064e\u062f\u064f\u0648\u0631 \u0645\u064e\u0639\u064e \u0639\u0644\u062a\u0647 \u0648\u062c\u0648\u062f\u0627 \u0648\u0639\u062f\u0645\u0627\/ H\u00fck\u00fcm var olmak ve yok olmak bak\u0131m\u0131ndan illetiyle deveran eder.\u201d<a href=\"#_ftn2\" name=\"_ftnref2\">[2]<\/a> Buna g\u00f6re, bir h\u00fck\u00fcm herhangi bir illet \u00fczerine mebni oldu\u011funda o illetin var olmas\u0131yla var olur, yok olmas\u0131yla yok olur. Yani illet varsa h\u00fck\u00fcm de var, illet yoksa h\u00fck\u00fcmde yok demektir. Bu noktada h\u00fckm\u00fcn ortadan kalkmas\u0131n\u0131n tarihsel veya yerel olmas\u0131yla bir ilgisi yoktur. Bilakis mesele tamamen h\u00fckm\u00fcn mesnedi olan illetin yok olmas\u0131yla ilgilidir.\u00a0 Binaen aleyh, Kur\u2019an veya S\u00fcnnet, bir illet \u00fczerine mebni olan bir h\u00fck\u00fcm vaz ettiklerinde o illetin kalkmas\u0131yla h\u00fckm\u00fcn devam etmesini talep etmezler. Zaten h\u00fckm\u00fc b\u00f6yle bir illet \u00fczerine mebni k\u0131lmalar\u0131n\u0131n anlam\u0131 da budur.<\/p>\n<p>Meselemize bu perspektiften bakt\u0131\u011f\u0131m\u0131zda bahsinde oldu\u011fumuz ayetin de vaz etti\u011fi h\u00fckm\u00fcn b\u00f6yle oldu\u011funu g\u00f6rm\u00fc\u015f olaca\u011f\u0131z. Zira, insanlar evlerde d\u0131\u015far\u0131dan girecek ki\u015filerin girmesine bir engel bulunmad\u0131\u011f\u0131 d\u00f6nemlerde Kur\u2019an\u2019\u0131 hakim, mahremiyeti korumak ve insanlar\u0131n istenmedik hal \u00fczere yakalanmamalar\u0131 i\u00e7in g\u00fcn\u00fcn istirahat vakitlerinde izin istenmesi uygulamas\u0131n\u0131 vaz etmi\u015ftir. Fakat daha sonralar\u0131 insanlar evlerini daha korunakl\u0131 hale getirince h\u00fckm\u00fcn illeti yok olmu\u015f ve bu uygulama da ortadan kalkm\u0131\u015ft\u0131r.<a href=\"#_ftn3\" name=\"_ftnref3\">[3]<\/a> Bu durum ayetin tarihsel veya yerel olmas\u0131yla de\u011fil mebni oldu\u011fu illetin zail olmas\u0131yla ilgili bir durumdur. Bunun b\u00e2riz delili \u015fudur: Ayn\u0131 illet geriye gelse ve insanlar ayetin geldi\u011fi zamanda mevcut olan evlerde ya\u015famaya ba\u015flasalar h\u00fck\u00fcm ayn\u0131yla geriye d\u00f6ner. Zira kaidemiz de bunu anlatmaktayd\u0131: H\u00fck\u00fcm var veya yok olma a\u00e7\u0131s\u0131ndan illetiyle deveran eder.<\/p>\n<p>Durum bundan ibaretken ve mesele tamamen us\u00fbl\u00ee bir zeminde ele al\u0131nmas\u0131 gerekiyorken \u00d6zt\u00fcrk buradan tarihselcilik tezine \u2013tabir yerindeyse- ekmek \u00e7\u0131kartmaya \u00e7al\u0131\u015fmaktad\u0131r. Bunu yaparken de \u0130bn Abbas t\u2019\u0131n mezkur tefsirinden destek almaya \u00e7al\u0131\u015fmay\u0131 da ihmal etmemektedir. Oysa \u0130bn Abbas (rad\u0131yallahu anh) \u00a0\u0642\u062f \u0630\u0647\u0628 \u062d\u0643\u0645\u0647\u0627\u00a0 \u201cBu ayetin h\u00fckm\u00fc gitmi\u015ftir\u201d demekle de<a href=\"#_ftn4\" name=\"_ftnref4\">[4]<\/a> bahsini yapt\u0131\u011f\u0131m\u0131z usuli tahlili kastetmektedir. Zira ayetin nazil olu\u015f sebeplerine bakt\u0131\u011f\u0131m\u0131zda tefsirlerde \u015fu durumlar kar\u015f\u0131m\u0131za \u00e7\u0131kmaktad\u0131r:<\/p>\n<ol>\n<li>\u0130bn Abbas (rad\u0131yallahu anh) bu ayetle ilgili olarak \u00f6zetle \u015f\u00f6yle demi\u015ftir: \u0130nsanlar\u0131n evlerinin kap\u0131lar\u0131nda bir tak\u0131m \u00f6rt\u00fcler vard\u0131 ve kap\u0131 vb. engeller yoktu. Bu durumda ki\u015finin evinde ya\u015fayan hizmet\u00e7isi, o\u011flu veya yetimi aniden kendisini ailesiyle birlikte oldu\u011fu anda basabiliyordu. Daha sonra Allah \ufdfb insanlar\u0131n r\u0131zk\u0131n\u0131 geni\u015fletince evlerine kap\u0131 vs. yapt\u0131lar. B\u00f6ylece insanlar \u00e2yette bahsedilen izin isteme uygulamas\u0131na ihtiya\u00e7lar\u0131n\u0131n kalmad\u0131\u011f\u0131n\u0131 g\u00f6rm\u00fc\u015f oldular.<\/li>\n<li>\u0130nsanlar ayette bahsedilen saatlerde han\u0131mlar\u0131yla birlikte olup gus\u00fcl alarak namaza gidiyorlard\u0131. Allah \ufdfb onlar\u0131n k\u00f6lelerine ve g\u0131lmanlar\u0131na bu saatlerde izin almalar\u0131n\u0131 emretmi\u015ftir.<a href=\"#_ftn5\" name=\"_ftnref5\">[5]<\/a><\/li>\n<li>Ensardan bir adam ve han\u0131m\u0131 Esma bintu M\u00fcr\u015fide Hz. Peygamber \ufdfa\u2019e yemek yapm\u0131\u015flard\u0131. \u0130nsanlar izinsiz \u015fekilde onlar\u0131n yan\u0131na girince Esma Efendimiz \ufdfa\u2019e: \u201cYa Resulellah! Bu ne \u00e7irkin \u015fey. Ki\u015fi han\u0131m\u0131yla tek bir elbise alt\u0131nda beraberken \u00e7ocuklar\u0131\/hizmet\u00e7ileri yanlar\u0131na girebiliyor\u201d dedi. Bunun \u00fczerine ilgili ayet-i kerime nazil oldu.<a href=\"#_ftn6\" name=\"_ftnref6\">[6]<\/a><\/li>\n<\/ol>\n<p>G\u00f6r\u00fcld\u00fc\u011f\u00fc gibi ayet-i kerime bu gibi durumlar \u00fczerine \u201cinsanlar\u0131n \u00f6zel hallerinde bas\u0131lmamas\u0131\u201d illeti \u00fczerine mebni olan \u201cg\u00fcn\u00fcn \u00fc\u00e7 mahrem vaktinde izin istenmesi\u201d h\u00fckm\u00fcn\u00fc vaz etmi\u015ftir. Ayetin burada hususen vurgulad\u0131\u011f\u0131 nokta h\u00fck\u00fcmden ziyade illettir. Bu sebeple ayetin nazil oldu\u011fu zamanda illetin meydana gelmesi bahsi ge\u00e7en h\u00fck\u00fcmle meydana gelebiliyordu. Sonralar\u0131 bu illet \u015fartlar\u0131n de\u011fi\u015fmesiyle ortadan kalk\u0131nca h\u00fckm\u00fcn uygulamadan kalkmas\u0131 da s\u00f6z konusu olabilmi\u015ftir. Ayet de zaten mezkur h\u00fckm\u00fc b\u00f6yle bir illet \u00fczerine bina etmekle bu durumu z\u0131mnen tasvip etmi\u015ftir.<\/p>\n<p>Bu meselenin her ayetin, zamanlar\u0131n ve \u015fartlar\u0131n de\u011fi\u015fmesiyle de\u011fi\u015febilece\u011fi \u015feklinde anla\u015f\u0131lmas\u0131 da hata olacakt\u0131r. Zira \u015fayet herhangi bir h\u00fck\u00fcm dinde katiyetle sabit olan, ve de\u011fi\u015fmesi m\u00fcmk\u00fcn olmayan bir illet \u00fczerine mebni ise bu illet hi\u00e7bir zaman ortadan kalkmayaca\u011f\u0131 i\u00e7in ayetin ispat etti\u011fi h\u00fckm\u00fcn de y\u00fcr\u00fcrl\u00fckten kalkmas\u0131 m\u00fcmk\u00fcn de\u011fildir. Fakat bahsinde oldu\u011fumuz ayette oldu\u011fu gibi, ayetle vaz edilen h\u00fck\u00fcm de\u011fi\u015fken bir illet \u00fczerine mebni ise bu h\u00fck\u00fcm ilgili illetin var olmas\u0131yla var olur ve yok olmas\u0131yla da y\u00fcr\u00fcrl\u00fckten kalkabilir. Bu durumun ne maslahat\u00e7\u0131l\u0131kla ne de tarihselcilikle bir ilgisi yoktur.<\/p>\n<p>\u015eu noktan\u0131n tavzih edilmeden ge\u00e7ilmesini de do\u011fru bulmuyoruz: Bu ayeti bahsini yapt\u0131\u011f\u0131m\u0131z illet \u00fczerine mebni g\u00f6rerek mezkur illetin yok olmas\u0131 sebebiyle h\u00fckm\u00fcn\u00fcn de uygulamadan kalkt\u0131\u011f\u0131n\u0131 savunanlar oldu\u011fu gibi ayetin halen h\u00fckmen baki oldu\u011funu savunanlar da vard\u0131r. \u0130mam et-Taber\u00ee gibilerinin nakletti\u011fine g\u00f6re e\u015f-\u015ea\u2018b\u00ee ve Said b. C\u00fcbeyr gibi zatlar bunlardand\u0131r.<a href=\"#_ftn7\" name=\"_ftnref7\">[7]<\/a> \u0130\u015fin ilgin\u00e7 olan taraf\u0131 \u00d6zt\u00fcrk\u2019\u00fcn ismi \u00fczerinden tezine referans k\u0131lmaya \u00e7al\u0131\u015ft\u0131\u011f\u0131 \u0130bn Abbas (rad\u0131yallahu anh) da bu ayetin mensuh olmad\u0131\u011f\u0131 bilakis insanlar\u0131n bu ayetle amel etmeyi terk ettikleri g\u00f6r\u00fc\u015f\u00fcndedir.<a href=\"#_ftn8\" name=\"_ftnref8\">[8]<\/a> Di\u011fer g\u00f6r\u00fc\u015fte oldu\u011fu nakledilse bile \u0130bn Abbas (rad\u0131yallahu anh)\u2019\u0131n bu ayetle amel edilmesinin kalkt\u0131\u011f\u0131 g\u00f6r\u00fc\u015f\u00fcndeki kast\u0131 asla \u00d6zt\u00fcrk\u2019\u00fcn anlad\u0131\u011f\u0131 manada de\u011fildir. Nitekim hangi manada oldu\u011funu yukar\u0131da beyan ettik. Bu sebeple \u0130mam el-Kurtub\u00ee el-Mehdev\u00ee yoluyla \u0130bn Abbas (rad\u0131yallahu anh)\u2019\u0131n \u201c<strong>\u0648\u064e\u0644\u064e\u0648\u0652 \u0639\u064e\u0627\u062f\u064e \u0627\u0644\u0652\u062d\u064e\u0627\u0644\u064f \u0644\u064e\u0639\u064e\u0627\u062f\u064e \u0627\u0644\u0652\u0648\u064f\u062c\u064f\u0648\u0628\u064f<\/strong> \/ \u015fayet o hal geriye gelse ayetin ispat etti\u011fi v\u00fccub da geriye gelir\u201d dedi\u011fini nakletmektedir.<a href=\"#_ftn9\" name=\"_ftnref9\">[9]<\/a><\/p>\n<p>Ayr\u0131ca ulema zaten ayette emredilerek bahsedilen uygulaman\u0131n v\u00fccub i\u00e7in mi yoksa nedb i\u00e7in mi oldu\u011fu noktas\u0131nda da ihtilaf etmi\u015flerdir.<a href=\"#_ftn10\" name=\"_ftnref10\">[10]<\/a> Cumhura g\u00f6re ilgili emir mendublu\u011fa hamledilmelidir.<a href=\"#_ftn11\" name=\"_ftnref11\">[11]<\/a> Ayetle amel edilmesinin kalkabilece\u011fini s\u00f6yleyenler zaten ayetteki emrin nedb i\u00e7in oldu\u011fu g\u00f6r\u00fc\u015f\u00fcndedirler. Hal buyken, \u00d6zt\u00fcrk ayette bahsedilen uygulamay\u0131 sanki dinin kat\u2019\u00ee ve ink\u00e2r\u0131 k\u00fcfr\u00fc gerektiren h\u00fck\u00fcmlerindenmi\u015f gibi g\u00f6stermekle de b\u00fcy\u00fck bir manip\u00fclasyona imza atmaktad\u0131r. Son olarak \u00d6zt\u00fcrk\u2019\u00fcn yan\u0131lg\u0131s\u0131na ve kar\u0131\u015ft\u0131rmalar\u0131na temel te\u015fkil etti\u011fini d\u00fc\u015f\u00fcnd\u00fc\u011f\u00fcm\u00fcz \u015fu iki noktay\u0131 tespit etmemiz gerekti\u011fi d\u00fc\u015f\u00fcncesindeyiz:<\/p>\n<ol>\n<li>\u0130nsanlar\u0131n herhangi bir ayetle, ayette ge\u00e7en emri nedb i\u00e7in sayd\u0131klar\u0131ndan veya ayetteki h\u00fckm\u00fcn illeti olarak g\u00f6rd\u00fckleri \u015feyin zail oldu\u011funu b\u00f6ylelikle h\u00fckm\u00fcn de ortadan kalkt\u0131\u011f\u0131n\u0131 savunarak amel etmeyi terk etmeleri ayetin mensuh oldu\u011fu, h\u00fckm\u00fcn\u00fcn k\u00fclliyyen kalkt\u0131\u011f\u0131, hele hele tarihsel ve yerel oldu\u011fu anlam\u0131na gelmez. \u0130ki mesele tamamen farkl\u0131 konulard\u0131r.<\/li>\n<li>Bir de \u015fu nokta var: \u0130nsanlar \u015fartlar\u0131n elveri\u015fli olmamas\u0131 sebebiyle tamamen kendi kusurlar\u0131ndan na\u015fi nedenlerle bir k\u0131s\u0131m ayetlerle amel edemiyor olabilirler. Bu durum o ayetlerin h\u00fckm\u00fcn\u00fcn ortadan kalkt\u0131\u011f\u0131na delil olamaz.<\/li>\n<\/ol>\n<p>Durum bundan ibaretken \u00d6zt\u00fcrk\u2019\u00fcn tarihsellik g\u00f6r\u00fc\u015f\u00fcne misal olarak zikretti\u011fi ayetlerin hemen tamam\u0131nda bu hususlar\u0131 fazlas\u0131yla birbirine kar\u0131\u015ft\u0131rd\u0131\u011f\u0131 g\u00f6r\u00fclmektedir.<\/p>\n<hr \/>\n<p><a href=\"#_ftnref1\" name=\"_ftn1\">[1]<\/a> \u00d6zt\u00fcrk, <em>Kur\u2019an ve Tefsir K\u00fclt\u00fcr\u00fcm\u00fcz<\/em>, s, 30-31<\/p>\n<p><a href=\"#_ftnref2\" name=\"_ftn2\">[2]<\/a> \u0130lgili kaide i\u00e7in bkz. Ahmed Muhammed ez-Zerk\u00e2, <em>\u015eerhu\u2019l-Kav\u00e2idi\u2019l-F\u0131khiyye<\/em>, Daru\u2019l-Kalem, D\u0131me\u015fk, Suriye, 1409, Bask\u0131: II, s. 483; Ebu Muhammed Salih b.
