De\u011filse bu g\u00fcn bu i\u015fi paras\u0131yla yapmayan yok denecek kadar az. Bu hususta bilgilendirmenizi rica ediyorum. Selamlar.<\/p><\/blockquote>\n<p><strong>Cevap: \u00a0<\/strong>Kur\u2019an okutma kar\u015f\u0131l\u0131\u011f\u0131nda \u00fccret almak meselesi sonu\u00e7 itibar\u0131yla kira akdine d\u00f6nen ve bu akitle ili\u015fkili olan bir konudur. Bu konu hakk\u0131nda varid olmu\u015f muhtelif rivayetler \u00fczerinden yap\u0131lan farkl\u0131 istidlaller bu meseleyi ihtilafa med\u00e2r k\u0131lm\u0131\u015ft\u0131r. \u015e\u00f6yle ki; \u0130mam e\u015f-\u015eafii, At\u00e2, Hasen b. Salih, \u0130mam Malik, \u0130shak (Rahimehumullah) gibi bir k\u0131s\u0131m m\u00fc\u00e7tehitler Kur\u2019an-\u0131 kerim \u00f6\u011fretme kar\u015f\u0131l\u0131\u011f\u0131nda \u00fccret talep etmenin caiz oldu\u011funu savunmu\u015flar<a href=\"#_ftn1\" name=\"_ftnref1\">[1]<\/a> ve delil olarak da \u015fu rivayetleri getirmi\u015flerdir:<\/p>\n<p><strong>Caiz oldu\u011funu g\u00f6steren rivayetler:<\/strong><\/p>\n<ol>\n<li>Allah Resul\u00fc (Sallallahu Aleyhi ve Sellem)\u2019 ne bir kad\u0131n gelip kendisini Allah ve Resul\u00fcne hibe etti\u011fini s\u00f6yler. Resulullah Aleyhissalat\u00fc vesselam\u2019 da bu kad\u0131na \u201ckendisinin kad\u0131na ihtiyac\u0131 olmad\u0131\u011f\u0131\u201d \u015feklinde mukabelede bulunur. Bunun \u00fczerine bir sahab\u00ee \u201cOnu benimler evlendir\u201d der. Efendimiz de bu sahab\u00eeye (kad\u0131na mehir olarak) bir elbise vermesini s\u00f6yleyince, Sahab\u00ee verecek elbisesinin bulunmad\u0131\u011f\u0131 \u015feklinde mukabele eder. Bunun \u00fczerine Resulullah (Aleyhissalat\u00fc vesselam) ona \u201cVelev ki demirden bile olsa ona bir y\u00fcz\u00fck ver\u201d der. Sahab\u00ee bunu da bulamay\u0131nca, Allah Resul\u00fc ona \u201cKur\u2019an\u2019dan haf\u0131zanda olanlar nelerdir?\u201d diye sorar. Sahab\u00ee\u2019 de ezberinde olan s\u00fcreleri say\u0131nca Efendimiz ona \u201c Kur\u2019an\u2019 dan ezberinde olanlarla seni bu kad\u0131nla nik\u00e2hlad\u0131m\u201d der. <a href=\"#_ftn2\" name=\"_ftnref2\">[2]<\/a> Kur\u2019an \u00f6\u011fretme mukabilinde \u00fccret almay\u0131 caiz g\u00f6renlerin delil olarak kulland\u0131klar\u0131 bir hadis de budur.<a href=\"#_ftn3\" name=\"_ftnref3\">[3]<\/a> Onlara g\u00f6re bu hadiste bu manaya delalet vard\u0131r.<a href=\"#_ftn4\" name=\"_ftnref4\">[4]<\/a><\/li>\n<li>H\u00e2rice b. Salb, amcas\u0131ndan rivayet etmi\u015ftir ki o \u015f\u00f6yle dedi: Resulullah\u2019 \u0131n huzurundan d\u00f6nd\u00fck ve bir arap kabilesinin yan\u0131na geldik. Onlar da \u201cbize haber verildi ki siz o adam\u0131n (Resulullah\u2019\u0131n) yan\u0131ndan hay\u0131rla (Kur\u2019an\u2019la, zikirle) gelmi\u015fsiniz. Biz de deli olan birisi var. Yan\u0131n\u0131zda ona kar\u015f\u0131 (uygulayabilece\u011finiz) bir tedavi y\u00f6ntemi var m\u0131?\u201d dediler. Biz de \u201cevet\u201d dedik. Onlar da deli oan ki\u015fiyi getirdiler. \u00dc\u00e7 g\u00fcn sabah ak\u015fam Fatiha s\u00fcresini okuyup t\u00fck\u00fcr\u00fc\u011f\u00fcm\u00fc toplayarak ona \u00fcfledim. B\u00f6ylece adam sanki ba\u011flanm\u0131\u015f oldu\u011fu ipten \u00e7\u00f6z\u00fclm\u00fc\u015f gibi oldu (ve hastal\u0131\u011f\u0131ndan kurtuldu). Bu amelime kar\u015f\u0131l\u0131k bana ecir verdiler. Ben de \u201cResulullah\u2019a soruncaya kadar hay\u0131r ( almam)\u201d dedim. Resulullah da \u015f\u00f6yle buyurdu: (Sana verdikleri ecri) ye! \u00d6mr\u00fcme yemin olsun ki; insanlardan bir k\u0131s\u0131mlar\u0131 bat\u0131l rukye kar\u015f\u0131l\u0131\u011f\u0131nda (ald\u0131klar\u0131 ecri) yemektedirler. Sen ise hak rukye (kar\u015f\u0131l\u0131\u011f\u0131nda edindi\u011fin ecri) yedin\u201d.<a href=\"#_ftn5\" name=\"_ftnref5\">[5]<\/a><\/li>\n<\/ol>\n<ul>\n<li>\u0130bn Abbas (Rad\u0131yallahu Anh)\u2019dan rivayet edildi\u011fine g\u00f6re Efendimiz (Sallallahu Aleyhi ve Sellem): <em>\u201cKar\u015f\u0131l\u0131\u011f\u0131nda ecir alman\u0131za en lay\u0131k olan \u015fey Allah\u2019\u0131n kitab\u0131d\u0131r\u201d <\/em>buyurmu\u015ftur.<a href=\"#_ftn6\" name=\"_ftnref6\">[6]<\/a> \u0130mam el-M\u00fcnavi, bu hadisin \u015ferhinde, bu rivayetin Kur\u2019an okutma mukabilinde \u00fccret alman\u0131n cevaziyetini ifade etti\u011fini s\u00f6yler. Yine el-M\u00fcnavi\u2019 ye g\u00f6re cevaz vermeyenlerin delil olarak kulland\u0131klar\u0131; Ubade b. Samit\u2019 e Kur\u2019an \u00f6\u011fretti\u011fi kimselerden birisi yay hediye etti\u011finde bu hediyeyi kabul edip etmemesini Efendimize sordu\u011funda Peygamberin ona s\u00f6yledi\u011fi: \u201c<em>Allah\u2019\u0131n k\u0131yamette boynuna ate\u015ften bir halka takmas\u0131n\u0131 arzu edersen onu kabul et!\u201d<\/em> \u015eeklindeki rivayetin \u015f\u00f6yle anla\u015f\u0131lmas\u0131 gerekti\u011fini s\u00f6yler: Ubade (Rad\u0131yallahu Anh)\u2019 nin niyeti bu i\u015fi mahza Allah i\u00e7in yapmak, kar\u015f\u0131l\u0131\u011f\u0131nda R\u0131zaullah\u2019tan ba\u015fka hi\u00e7bir \u015fey talep etmemekti. Efendimiz de onun ecrinin ve sevab\u0131n\u0131n zayi\u2019 olmas\u0131n\u0131 istemeyerek bu hediyeyi almas\u0131n\u0131 ho\u015f kar\u015f\u0131lamad\u0131.<a href=\"#_ftn7\" name=\"_ftnref7\">[7]<\/a><\/li>\n<\/ul>\n<p>G\u00f6r\u00fcld\u00fc\u011f\u00fc \u00fczere bu hadisler a\u00e7\u0131k bir \u015fekilde Kur\u2019an okutma mukabilinde para alman\u0131n cevaziyetine delalet etmektedir. Yaz\u0131m\u0131z\u0131n bundan sonraki b\u00f6l\u00fcm\u00fcnde ise buna cevaz vermeyenlerin gerek\u00e7e olarak \u00f6ne s\u00fcrd\u00fckleri rivayetlerin serdedilmesi ve yukar\u0131daki nakiller hakk\u0131ndaki tahlili yorumlar\u0131n\u0131n nakledilmesiyle devam edelim:<\/p>\n<p><strong>\u00a0<\/strong><\/p>\n<p><strong>Caiz olmad\u0131\u011f\u0131n\u0131 g\u00f6steren rivayetler:<\/strong><\/p>\n<ol>\n<li>Ubade b. Samit\u2019 den nakledilmi\u015ftir ki o \u015f\u00f6yle dedi: Ben Suffe ehlinden bir tak\u0131m insanlara Kur\u2019an \u00f6\u011fretiyordum. Onlardan birisi Alah yolunda kabul etmem \u00fczere bana bir yay hediye etti. Bunu Resulullah\u2019a s\u00f6yleyince O bana \u201c<em>Allah\u2019\u0131n k\u0131yamette boynuna ate\u015ften bir halka takmas\u0131n\u0131 arzu edersen onu kabul et!\u201d <\/em>buyurdu.<a href=\"#_ftn8\" name=\"_ftnref8\">[8]<\/a><\/li>\n<li>Osman b. Ebi\u2019l-As\u2019 dan rivayet edildi\u011fine g\u00f6re Resulullah Aleyhissalat\u00fc vesselam: <em>\u201cEzan okumas\u0131 mukabilinde \u00fccret almayan bir m\u00fcezzin tut\u201d<a href=\"#_ftn9\" name=\"_ftnref9\"><strong>[9]<\/strong><\/a> <\/em>buyurmu\u015ftur. Bu hadis her ne kadar konu a\u00e7\u0131s\u0131ndan ezanla ilgiliyse de her ikisi de taat olmas\u0131 a\u00e7\u0131s\u0131ndan Kur\u2019an okutma ameli ile ayn\u0131d\u0131rlar.<\/li>\n<\/ol>\n<ul>\n<li>\u00dcbeyy b. Ka\u2019b (Rad\u0131yallahu Anh)\u2019 dan rivayet edildi\u011fine g\u00f6re o engelli birisine Kur\u2019an \u00f6\u011fretmekte ve o ki\u015fi de her geldi\u011finde ona yemek yedirmekteydi. \u00dcbey b. Ka\u2019b bundan dolay\u0131 i\u00e7inde bir rahats\u0131zl\u0131k hissedip Resulullah\u2019a bu durumu sorunca Allah Resul\u00fc ona: \u015eayet bu onun sana hediye kabilinden verdi\u011fi bir \u015feyse onda hi\u00e7bir hay\u0131r yoktur. E\u011fer onun ve ehlinin yeme\u011findense bunda bir beis yok\u201d buyurdu.<a href=\"#_ftn10\" name=\"_ftnref10\">[10]<\/a><\/li>\n<\/ul>\n<p><strong>Yukar\u0131daki rivayetlerin de\u011ferlendirmeleri:<\/strong><\/p>\n<p>Hanefiler ba\u015fta olmak \u00fczere Kur\u2019an \u00f6\u011fretme ve her nevi taat kar\u015f\u0131l\u0131\u011f\u0131nda \u00fccret al\u0131namayaca\u011f\u0131n\u0131 savunanlar cevaza y\u00f6nelik rivayetleri farkl\u0131 de\u011ferlendirmektedirler. S\u00f6z konusu de\u011ferlendirmelere numara s\u0131ras\u0131na riayet ederek at\u0131f yapal\u0131m:<\/p>\n<ol>\n<li>Allah Resul\u00fc\u2019 n\u00fcn sahabi\u2019 yi, s\u00fcreleri mehir yaparak evlendirmesinde Kur\u2019an okuma kar\u015f\u0131l\u0131\u011f\u0131nda \u00fccret al\u0131nabilece\u011fine kesin bir delalet yoktur. \u00c7\u00fcnk\u00fc bu rivayet de bir tak\u0131m ihtimaller s\u00f6z konusu olabilir: Bu ihtimaller c\u00fcmlesinden olarak; bu fiil \u0130mam et-Tahavi\u2019 nin de belirtti\u011fi gibi Peygambere mahsus olan Hasais-i Nebeviye\u2019 den olabilir. \u00c7\u00fcnk\u00fc Allah Te\u00e2la sadece ona mehirsiz bir \u015fekilde kad\u0131na sahip olmay\u0131 caiz k\u0131lm\u0131\u015ft\u0131r. Ba\u015fkas\u0131 i\u00e7in bu h\u00fck\u00fcm ge\u00e7erli olamaz. Bu durumda bunu ba\u015fkas\u0131n\u0131n taklit etmesi s\u00f6z konusu olmayacakt\u0131r. Zira rivayette g\u00f6r\u00fcld\u00fc\u011f\u00fc \u00fczere kad\u0131n peygambere gelip kendisini ona hibe etti\u011fini bildirmi\u015f, bir sahabi\u2019de \u201conu benimle evlendir\u201d demi\u015ftir. Peygamberin kad\u0131nla isti\u015fare etti\u011fi veya kad\u0131n\u0131n peygambere \u201cbeni bununla evlendir\u201d dedi\u011fi sabit de\u011fildir. \u015eu halde g\u00f6z\u00fcken odur ki; Allah Resul\u00fc bu kad\u0131n\u0131 kendisine mahsus olan M\u00fcsl\u00fcman kad\u0131nlar\u0131n kendilerini ona hibe etmeleri hakk\u0131yla evlendirmi\u015ftir. Bu noktada itiraz olarak \u00e7\u0131k\u0131p birisi; \u201cBelki Peygamber bu kad\u0131na o adamla evlenmek isteyip istemedi\u011fini sormu\u015ftur fakat olay\u0131n bu boyutu nakledilmemi\u015ftir\u201d diyecek olursa ona \u015f\u00f6yle s\u00f6ylenir: \u201cBelki Peygamber bu kad\u0131na bir mehir verilmesini takdir etmi\u015ftir fakat rivayetin bu b\u00f6l\u00fcm\u00fc nakledilmememi\u015ftir.<a href=\"#_ftn11\" name=\"_ftnref11\">[11]<\/a> Ayr\u0131ca sahabeden \u00dcmm\u00fc S\u00fcleym (Rad\u0131yallahu Anha) Ebu Talha\u2019dan \u00f6nce m\u00fcsl\u00fcman oldu. Ebu Talha (Rad\u0131yallahu Anh) da onunla evlenmek isteyince o \u201cBen M\u00fcsl\u00fcman oldum, sen de M\u00fcsl\u00fcman olursan seninle evlenirim\u201d demi\u015fti. O da M\u00fcsl\u00fcman olmu\u015f ve ikisinin aras\u0131ndaki bu evlilikte \u0130slam mehir olmu\u015ftu.<a href=\"#_ftn12\" name=\"_ftnref12\">[12]<\/a> Bu rivayette her ne kadar d\u00een\u00ee menfaaetlerin kad\u0131ndan faydalanmaya kar\u015f\u0131l\u0131k mehir olabilece\u011fi ve bu ba\u011flamda Kur\u2019an \u00f6\u011fretme mukabilinde para al\u0131nabilece\u011fine delalet varsa da mezk\u00fbr rivayeti iki sebepten dolay\u0131 bu \u015fekilde anlayamay\u0131z. Bu iki vecihten birisi; Bu \u015fekildeki bir h\u00fckm\u00fcn icmaa muhalif olmas\u0131d\u0131r. \u0130kincisi de; b\u00f6yle bir fetvan\u0131n Allah Azze ve Celle\u2019 nin <em>\u201cBunlardan ba\u015fka kad\u0131nlar\u0131 ise iffetli, zinadan ka\u00e7\u0131n\u0131r oldu\u011funuz halde mallar\u0131n\u0131zla talep etmeniz size helal k\u0131l\u0131nm\u0131\u015ft\u0131r\u201d<a href=\"#_ftn13\" name=\"_ftnref13\"><strong>[13]<\/strong><\/a> <\/em>\u015feklindeki kavl-i \u015ferifine z\u0131tt\u0131r. \u00c7\u00fcnk\u00fc ayet-i kerimede mehir olarak verilmesi gereken \u015feyin mal olmas\u0131 gerekti\u011fi buyurulmaktad\u0131r. Menfaat olan bir \u015feye mal tabirinin kullan\u0131lamayaca\u011f\u0131 ise icma\u2019 ile sabittir.<a href=\"#_ftn14\" name=\"_ftnref14\">[14]<\/a><\/li>\n<li>Sahabe-i kiram\u2019\u0131n hastalar\u0131 okuyup kar\u015f\u0131l\u0131\u011f\u0131nda \u00fccret ald\u0131klar\u0131na dair olan rivayetler ise \u201cTa\u2019limu\u2019l-Kur\u2019an\/Kur\u2019an \u00f6\u011fretme\u201d konusuyla de\u011fil de daha \u00e7ok \u201cRukye\/okuyup \u00fcfleme konusuyla ilgilidir. Ve sahabenin bununla maksad\u0131 da herhangi bir \u00fccret almak de\u011fildi. \u0130mam Tahavi bu konuda mefhumen \u015funlar\u0131 s\u00f6yler: Rukyeler ve ila\u00e7lara kar\u015f\u0131l\u0131k \u00fccret al\u0131nmas\u0131nda bir beis yoktur. Zira Rukye yapmak insanlar\u0131n tamam\u0131 \u00fczerine vacip ve gerekli olan bir \u015fey de\u011fildir. Lakin Kur\u2019an-\u0131 Kerim \u00f6\u011fretmek b\u00f6yle de\u011fildir. \u00c7\u00fcnk\u00fc insanlar\u0131n bir k\u0131sm\u0131n\u0131n di\u011fer bir k\u0131sma Kur\u2019an \u00f6\u011fretmesi vaciptir. Zira bu i\u015fte Allah Te\u00e2la\u2019dan tebli\u011f etme vard\u0131r. Ancak \u015fu kadar\u0131 var ki; insanlardan belli bir b\u00f6l\u00fcm\u00fc bunu yap\u0131nca di\u011ferlerinden y\u00fck\u00fcml\u00fcl\u00fck kalkar. Cenaze namaz\u0131 gibi ki; insanlardan belli bir k\u0131sm\u0131n bu g\u00f6revi yerine getirmesi di\u011ferlerinin \u00fczerinden bu i\u015fin y\u00fck\u00fcml\u00fcl\u00fc\u011f\u00fcn\u00fcn kalkmas\u0131 i\u00e7in yeterlidir. \u015eayet bir adam \u00f6len velisi i\u00e7in namaz k\u0131lmas\u0131 gayesiyle bir adam\u0131 kiralayacak olsa bu caiz olmaz. Zira bu adam bi zatihi velinin yerine getirmesinin farz oldu\u011fu bir mesele hususunda bu ki\u015fiyi kiralam\u0131\u015ft\u0131r. \u0130\u015fte, Kur\u2019an \u00f6\u011fretme konusu da bundan farkl\u0131 de\u011fildir. \u0130nsanlar\u0131n bir k\u0131sm\u0131, di\u011fer kimseleri kendilerine Kur\u2019an \u00f6\u011fretmeleri maksad\u0131yla tuttu\u011funda bu i\u015f bat\u0131l olur. \u00c7\u00fcnk\u00fc bu hocay\u0131 tutan ki\u015fi, Allah i\u00e7in kendisi \u00fczerine farz olan ve bu i\u015fi kendisinin yapmas\u0131n\u0131n gerekli oldu\u011fu bir meselede onu kiralam\u0131\u015ft\u0131r. Zira bu vazifenin bu ki\u015fi \u00fczerinden d\u00fc\u015fmesi bu g\u00f6revi bilfiil kendisinin yerine getirmesiyle olacakt\u0131r. \u0130care\/ kiralama olay\u0131 ise sadece ve sadece kiralanan ki\u015filerin kendilerini kiralayanlar ad\u0131na i\u015f yapabilecekleri meselelerde olur.<a href=\"#_ftn15\" name=\"_ftnref15\">[15]<\/a><\/li>\n<\/ol>\n<ul>\n<li>\u00a0\u00dc\u00e7\u00fcnc\u00fc olarak zikredilen \u201c<em>\u201cKar\u015f\u0131l\u0131\u011f\u0131nda ecir alman\u0131za en lay\u0131k olan \u015fey Allah\u2019\u0131n kitab\u0131d\u0131r\u201d <\/em>\u015feklindeki hadis de hakeza Rukye ba\u011flam\u0131nda s\u00f6ylenmi\u015ftir. Zira Rukyenin kar\u015f\u0131l\u0131\u011f\u0131ndan sonra s\u00f6ylenmi\u015f olmas\u0131 bunun bir delilidir.<a href=\"#_ftn16\" name=\"_ftnref16\">[16]<\/a> \u00dcstelik hadiste g\u00f6r\u00fcld\u00fc\u011f\u00fc \u00fczere kendilerinden Rukye kar\u015f\u0131l\u0131\u011f\u0131nda \u00fccret al\u0131nan kimseler k\u00e2fir kimseler olup, misafiri a\u011f\u0131rlamalar\u0131 \u015feklindeki vazifelerini ifa etmemi\u015ftiler. Her \u015feyden \u00f6te; Rukye mahza kurbet manas\u0131nda olan bir ibadet de\u011fildir.<a href=\"#_ftn17\" name=\"_ftnref17\">[17]<\/a> Dolay\u0131s\u0131yla bu hadis de \u201cKur\u2019an \u00f6\u011fretme\u201d konusuyla de\u011fil \u201cRukye\u201d konusuyla ilgilidir.<\/li>\n<\/ul>\n<p><strong>Hanefilerin Meseleye Bak\u0131\u015f\u0131: <\/strong><\/p>\n<p>Hanefilerin bu mesele hususundaki g\u00f6r\u00fc\u015f\u00fc yukar\u0131da \u0130mam et-Tahavi\u2019den cevap sadedinde nakletti\u011fimiz ifadelerde mevcuttur. Hanefi mezhebine g\u00f6re taat, ibadet kabilinden olup ki\u015finin bilfiil kendisinin yapmas\u0131n\u0131n gerekli oldu\u011fu meselelerde kira akdi caiz de\u011fildir. Dolay\u0131s\u0131yla Hanefilerce \u201cTa\u2019limu\u2019l-Kuran\/ Kuran \u00f6\u011fretme\u201d amelinin muavaza akitlerine konu olmas\u0131 sahih de\u011fildir.<a href=\"#_ftn18\" name=\"_ftnref18\">[18]<\/a> Bunun i\u00e7indir ki; \u0130mam Muhammed <em>\u201cel-Asl\u201d<\/em>\u0131nda \u201cBir M\u00fcsl\u00fcman\u0131n di\u011fer bir M\u00fcsl\u00fcmandan namaz k\u0131lmas\u0131 i\u00e7in mescidi kiralamas\u0131n\u0131n bat\u0131l olaca\u011f\u0131n\u0131 \u00e7\u00fcnk\u00fc bunun Allah\u2019a taat oldu\u011funu ve b\u00f6yle bir bir \u015fey \u00fczerine icare \/kiralama akdi yapman\u0131n ge\u00e7erli olmayaca\u011f\u0131n\u0131 belirtir. \u0130mam Muhammed\u2019 e g\u00f6re bu hususta farz namazla nafile namaz aras\u0131nda her hangi bir fark yoktur. Hakeza, bir ki\u015finin nafile veya farz namazlar\u0131 kendilerine k\u0131ld\u0131rmas\u0131 i\u00e7in \u015fah\u0131s kiralamalar\u0131 da b\u00f6yledir.
