Yani bu i\u015fi yapamad\u0131\u011f\u0131ndan dolay\u0131 yemin keffareti \u00f6demesi gerekir mi?<\/p>\n<p><strong>Cevap: <\/strong>Bir \u015feyin m\u00fcmk\u00fcnl\u00fc\u011f\u00fc duruma g\u00f6re de\u011fi\u015fir. Yani baz\u0131 \u015feyler vard\u0131r ki bunlar\u0131n olmas\u0131 aklen m\u00fcmk\u00fcn de\u011fildir. Mesela, gece ile g\u00fcnd\u00fcz\u00fcn bir araya gelmesi veya bir \u015feyin ayn\u0131 anda siyah ve beyaz olmas\u0131 gibi ki biz bunlara &#8220;m\u00fcstahilu\u2019l-v\u00fccud\u201d diyoruz. Bu k\u0131s\u0131m olaylara da tahakkuk etmeleri durumunda \u201chariku\u2019l-\u00e2de\u201d olaylar diyoruz.<\/p>\n<p>Bu konuya girmeden \u00f6nce bir mukaddime yap\u0131lmas\u0131n\u0131n uygun olaca\u011f\u0131 kanaatindeyiz: Bilindi\u011fi gibi yeminler mutlak<a href=\"#_ftn1\" name=\"_ftnref1\">[1]<\/a> ve muvakkat<a href=\"#_ftn2\" name=\"_ftnref2\">[2]<\/a> \u015feklinde iki k\u0131s\u0131mda incelenir. \u0130mam Ebu Hanife ve \u0130mam Muhammed\u2019e g\u00f6re yap\u0131lan yemin mutlak bir yeminse buradaki \u015fart yemini yerine getirmenin aklen m\u00fcmk\u00fcn olmas\u0131d\u0131r.<a href=\"#_ftn3\" name=\"_ftnref3\">[3]<\/a> Buna g\u00f6re, ki\u015fi her hangi bir vakit zikretmeksizin \u00f6n\u00fcnde duran bo\u015f barda\u011f\u0131 g\u00f6stererek \u201cVallahi ben bu bardaktaki suyu i\u00e7meyece\u011fim\u201d veya \u201c\u015eu bardaktaki suyu i\u00e7ersem han\u0131m\u0131m bo\u015f olsun\u201d diye yemin edecek olsa Tarafeyne g\u00f6re bu yeminin her hangi bir ge\u00e7erlili\u011fi olmayacakt\u0131r. \u00c7\u00fcnk\u00fc bardak bo\u015ftur. \u015eayet bu noktada birisi kalk\u0131p \u201cNeden bu muhal olsun ki? Allah Te\u00e2l\u00e2 dilese o bardakta su yaratamaz m\u0131?\u201d diye itirazvari bir soru soracak olsa \u015f\u00f6yle cevap verilebilir: \u201cO bardakta Allah\u2019\u0131n suyu yaratmas\u0131 tabi ki muhal de\u011fildir. Ama varsayal\u0131m ki Allah Azze ve Celle bardakta su yaratsa bile bu su ki\u015finin i\u00e7meyece\u011fine dair yemin etti\u011fi su olmaz, ba\u015fka bir su olur\u201d. \u015eu halde al\u00e2 k\u00fclli hal bu ki\u015finin mezkur \u015fekildeki yeminini tutmas\u0131 m\u00fcmk\u00fcn de\u011fildir.<\/p>\n<p>Yap\u0131lan yemin \u015fayet muayyen bir vakitle tayin edilmi\u015f yemin ise bu durumda mutlak yemindeki \u201caklen m\u00fcmk\u00fcn olmakl\u0131k\u201d \u015fart\u0131n\u0131n yan\u0131nda bir de \u201c\u00dczerine yemin edilen \u015feyin o vaktin sonuna kadar baki kalmas\u0131 \u015fart ko\u015fulur\u201d. \u015eu halde \u201c\u015eu bardaktaki suyu bu g\u00fcn i\u00e7ece\u011fim\u201d diye bir kimse yemin etmi\u015f olsa, daha sonra g\u00fcn bitmeden birisi gelip bardaktaki suyu d\u00f6kse veya g\u00fcn hen\u00fcz sona ermeden adam \u00f6lecek olsa ki\u015fi yemininde hanis olmaz. \u00c7\u00fcnk\u00fc bu muvakkat bir yemindir. Ve muvakkat yeminde aranan \u201cyemin edilen \u015feyin vaktin sonuna kadar bekas\u0131\u201d \u015feklindeki \u015fart tahakkuk etmemi\u015ftir. Mesela \u00f6lm\u00fc\u015f oldu\u011funu bilerek \u00f6l\u00fc bir insan i\u00e7in \u201cVallahi onu \u00f6ld\u00fcrece\u011fim\u201d diye yemin edecek olsa yemini m\u00fcn\u2019akid olur\/ge\u00e7erli olur ve bu ki\u015fiye keffaret gerekli olur. \u00c7\u00fcnk\u00fc, Allah\u2019\u0131n onu tekrardan diriltmesi ve bu suretle yemin eden kimsenin onu \u00f6ld\u00fcrmesi m\u00fcmk\u00fcnd\u00fcr.
